The Town of Danvers Conservation Commission granted a waiver to allow work in the 50-foot no-build zone and issued an order of conditions for work at 3 LeBlanc Drive, DEP file 14-1437.
Applicants John Michael Pizzi and Amanda Pizzi told the commission the project includes an in-ground pool (16 by 32 feet) with a fence that crosses the 50-foot buffer. John Michael Pizzi said the fence will be installed “along the existing grass line” and that they plan to add about 100 square feet of pollinator-friendly plantings as a mitigation or enhancement.
Commission staff confirmed the pool deck and main hardscape would sit outside the 50-foot zone and that erosion-control measures and other conditions would be placed on the order of conditions. Staff explained the standard pool-draining condition: water should be allowed to sit and chlorine should dissipate before discharge. One staff member said the practice is to “let it sit idle for I believe it’s 48 hours” before water may be removed without added chemicals; the applicant later said he had been told to wait a week to let chlorine dissipate. Commissioners required that the applicant revise the plan to show the equipment pad relocated against the house (as stated by the applicant) and put the plan changes on the final approved drawings.
The commission voted to close the public hearing, grant the waiver to allow the fence work within the 50-foot no-build zone, and issue an order of conditions with the additional conditions discussed at the meeting. The motion and vote were recorded by voice; no roll-call tally with named votes was read into the record.
The applicant acknowledged they will consult with their environmental consultant, Bill Emmanuel, to incorporate the plan changes noted by the commission.
