Lakeville Zoning Board of Appeals continues two hearings, approves minutes

The Town of Lakeville Zoning Board of Appeals on April 17 voted to continue two public hearings — one on a requested special permit for a carport at 45 Howland Road and another on requested modifications to a comprehensive permit for the LeBaron residential project — to the board's next meeting on May 15. The board also approved minutes from its Feb. 27 meeting and confirmed upcoming meeting dates, including a May 12 continuation of the Simmons Hill (Rocky Woods) project.

The continuance for the Burke petition was requested after the board determined that the required newspaper notification had not been properly published. The petitioner, identified in the agenda as Jeremy Burke, had sought a special permit under Town of Lakeville zoning provisions cited in the agenda as sections 270-6.1 and 270-7.4 to locate a 20-by-20-foot carport within the property's setback. The board opened the item to preserve the application date but voted to continue the public hearing to May 15 to allow proper notice and further processing.

The board also accepted a written request from counsel for LeBaron Residential LLC to continue a public hearing on requested modifications to an existing comprehensive permit for construction of Phase 6 of the LeBaron project. The project's consultant (identified in the meeting packet as Bike Engineering) submitted revised plans and a response to comments from Beals and Thomas; the board said Beals and Thomas had not yet finished reviewing the revisions. The continuation was granted so the reviewers could complete their analysis and the matter could be further considered at the May meeting.

Procedural actions taken at the meeting included approval of the Feb. 27 meeting minutes (moved and seconded; vote recorded as unanimous) and a motion to adjourn. The board announced its next regular meeting on Thursday, May 15, and a separate continuation meeting for the Simmons Hill/Rocky Woods project on Monday, May 12; the May 12 session was scheduled to be held at Boone Pond Lodge.

Board members did not engage in substantive debate on either continued item during the public portion of this meeting; the LeBaron continuation was requested by letter from counsel dated April 14 and was described in the meeting packet as including revised engineering plans. One member stated a recusal during the LeBaron item when the motion was made; the board proceeded to vote and continued the hearing to May 15.

No final determinations were made on either the Burke carport request or the LeBaron comprehensive-permit modification at this meeting; both matters were continued for further review and notice. The board adjourned at approximately 7:06 p.m.
