EQB delays final vote on updated bylaws after member amendments and public comment; board will return with revisions

The Environmental Quality Board reviewed a revised draft of its bylaws at its April 16 meeting but voted to table final adoption to a future board meeting after members proposed amendments and public commenters requested stronger recognition of public participation.
Executive Director (name in packet: Nuschler) walked the board through the principal edits since the January draft: (1) added a statutory reference to Minn. Stat. §13.02 for definitions around nonpublic data; (2) moved existing non-delegation language to the duties section; (3) clarified voting mechanics to state an affirmative vote of a majority of all board members is needed to take action (the board noted that vacancies do not count toward the total); (4) adopted aspects of the small-board parliamentary procedures while specifying the board will continue to require a second for motions; (5) expanded the staff section to describe executive director duties, program staff roles (including environmental review and technical representatives), and administrative responsibilities; and (6) changed the amendment threshold language to require a majority vote for bylaw changes (staff said this change aligned bylaws with board rule requirements).
Several board members proposed additional language changes. Board member Bauerkemper proposed two amendments: (a) language to make clear that "no one shall act to indicate that the board has taken a position unless the board has indeed taken such a position," and (b) language drawing agenda-creation obligations from board rules into the bylaws (the chair must advise the board of suggested items omitted from the agenda). Members discussed placement and scope for the first idea (whether language should explicitly address staff, technical representatives and task forces) and agreed more time and drafting clarity were needed.
The board opened a public-comment period on the bylaws. Willis Madison (former MPCA staff, identified in comment) urged the board to add an explicit provision on public participation. Another commenter, Hudson Kingston (CURE), and others used the general public-comments period later in the meeting to raise concerns about specific pending projects and permitting decisions (see meeting record). Executive Director Nuschler noted the board had received substantial written materials on some of those permitting questions (for example, a DNR document related to environmental-review decisions for a mining project) and offered to provide written responses where appropriate.
After discussion, a motion to table final adoption to a future meeting carried on a roll call that the chair characterized as unanimous among members present. The board did not adopt the bylaws at the April meeting; staff said they will draft revisions that reflect the board’s discussion and the suggested amendments and return at a future meeting for further consideration.
