The Fulton County Board of Commissioners opened a public hearing April 21 on a petition from Jerry Robles to vacate partial alleyways and a segment of West Street in the Marshland plat in Albany Township, then closed the hearing and deferred final action to the board’s next meeting.
Robles’s petition, recorded in the ordinance language as O4212025A, describes three partial rights-of-way to be vacated: an approximately 12-foot-wide by 95-foot east–west partial alley between Lots 66 and 41 and Lots 65 and 42 (Marshland); an approximately 10-foot-wide by 250-foot north–south alley between Lots 66 and 65 and between Lots 41 and 42; and a partial street named West Street described as roughly 20 feet wide and about 246 feet in length, plus an adjoining 25-foot-wide segment about 165 feet long north of Lots 41 and 66.
At the hearing Robles said he owns most of the parcels around the alleys and is seeking to “clean the place up” and combine the parcels into a single contiguous lot, adding that much of the area is overgrown and contains old buildings that have been torn down. “I’m just trying to clean the place up,” Robles told the commissioners.
The board confirmed public notice of the hearing was published in the Rochester Sentinel on April 21, 2025. The commissioners closed the public hearing (motion carried 3–0) and completed a second reading of the ordinance by title; they opted not to complete the third reading that night and scheduled the final reading for the next commissioners’ meeting to allow additional public notice time in case of any objections.
Why it matters: vacating a public alley or street changes public access rights and can affect utilities that have facilities within the vacated right-of-way; the ordinance preserves existing public-utility rights in the vacated areas as it was written.
The petitioner said he sent notice letters to adjacent owners; he told the board most of the alleys border property he owns and only one short alley on the far east side might have another owner. The board’s decision to defer final action provides an additional opportunity for any interested party to lodge objections before a conclusive vote.
