Santa Barbara council adopts expanded "just cause" eviction rules after public debate

The Santa Barbara City Council voted 4–2 April 29 to adopt amendments to the city’s tenant-protection ordinance addressing so-called just-cause evictions.
The ordinance, presented as Item 4 on the consent calendar, was moved by Council member Santa Maria and seconded by Council member Sneddon. The roll-call vote recorded Council member Gutierrez, Council member Harmon, Council member Santa Maria and Council member Sneddon as voting yes; Council member Jordan and Mayor Randy Rouse voted no.
Supporters of stronger tenant protections, who spoke during the public-comment period on the item, urged passage. “This is a huge win for the community,” said Stanley Zankoff, a tenant-rights supporter who testified in favor of the ordinance. Several other speakers—tenants and service providers—thanked council members for advancing tenant protections at a time of housing instability.
Opponents and some property owners urged the council to clarify parts of the ordinance before enactment. Florette Janigian, a speaker who identified herself as a landlord or property stakeholder, questioned how the ordinance defines a “qualified tenant” eligible to re-rent a unit after two years and asked whether landlords may re-screen returning tenants for employment or ability to pay. Janigian warned that the language could impose continuing financial risk on property owners if re-rental obligations are ambiguous.
Council members debated those procedural and legal concerns during the meeting. Council member Jordan pressed for ways to recognize proposals that go beyond minimum standards in related city procurement and planning processes, and several council members asked staff to clarify enforcement and appeals processes in follow-up materials.
The adopted ordinance modifies sections of Chapter 26.5 of the Santa Barbara Municipal Code to address just-cause evictions and adds a new section (26.5.0.09). City staff had pulled the item from the initial consent vote for separate consideration after public speakers requested separate action.
Council members and staff said clarifications and implementation details will be supplied as the ordinance is enacted and enforced. The council did not send the ordinance back to committee; the measure passed at the April 29 meeting and will be reflected in the municipal code as amended.
The decision followed a larger public-comment session at which tenants, housing advocates and providers described the urgency of stronger tenant protections and recounted cases of housing instability. Council members who voted yes said the changes aim to prevent sudden displacement while leaving defined remedies for landlords; those who voted no said more specificity or protections for property owners should be added.
