The Olathe Planning Commission voted unanimously to approve VAC25-0001, a request to vacate a public alley in the right-of-way between 125 and 135 South Kansas Avenue to facilitate an outdoor dining area for a new restaurant at 135 S. Kansas Ave.
Emily Carrillo, senior staff, told commissioners that the proposed vacation is “necessary to facilitate the development of an outdoor dining area associated with the new restaurant planned for 135 South Kansas Avenue.” She said that all public notification requirements were met and that staff “does recommend approval with no stipulations.” Carrillo also reported that the adjacent property owner to the north at 125 South Kansas Avenue has been “actively involved and supportive throughout this process.”
The commission heard no public testimony on the item. Commissioner Breen moved to approve VAC25-0001; Commissioner Chapman seconded. The motion passed by roll call, 7-0, with two commissioners absent (Corcoran and Lynn). Staff noted the item will proceed to the Olathe City Council on May 20 for final action.
Commissioners did not request additional conditions or stipulations during their discussion. The commission’s consent agenda earlier in the meeting, which included five items, also passed 7-0. During announcements, commissioners encouraged public participation in the city’s comprehensive plan open houses scheduled for May 29 (Indian Creek Library) and June 5 (Lakeville Community Center); more information is posted at olathas.gov/elevateolathe. The commission said it plans to meet next at Olathe City Hall on June 9.
