On the RDA agenda, the Daggett County board approved posting a $5,000 bond connected to an amended condemnation complaint for a construction easement across parcel number 02-00A1-1500.
County staff explained the RDA previously posted an $18,000 bond to cover immediate occupancy of the property; the additional $5,000 is required because the amended complaint added a construction easement across the driveway in front of Destron Resort (as described in the transcript). The $5,000 is an additional deposit required by the court and would be applied to the value of the easement if the judge rules accordingly. A staff member explained the county does not lose the posted bond if it complies with the immediate-occupancy terms; the money remains part of the RDA’s funds while litigation is pending.
A motion to post the $5,000 bond for parcel number 02-00A1-1500 was made and seconded; the commission approved the motion by voice vote. The RDA will post the bond and proceed with the amended condemnation process as described in the amended complaint.
