The Daggett County Commission voted to approve a photography licensing agreement with photographer Ryan Kelly that grants the county a perpetual, nonexclusive right to use specified images.
The agreement as approved gives the county a worldwide, nonexclusive, perpetual license for commercial and promotional uses while allowing Kelly to continue to use the images; the county retains the right to use the images indefinitely, and Kelly may not grant an exclusive right to a third party that would conflict with the county’s license.
Kent, a staff member, explained the options and the drafting: “I have a nonexclusive worldwide perpetual license. I can make that an exclusive worldwide perpetual license, at which point we would then own them and Ryan couldn't use them,” and later clarified the draft now reads as nonexclusive perpetual use. Commissioners discussed whether exclusivity was necessary given ambiguous prior arrangements with the chamber of commerce. The county’s counsel and staff favored a nonexclusive perpetual license to ensure the county can use the photos indefinitely while not claiming exclusive ownership when prior arrangements with the chamber were unclear.
Commissioner Jack Lydell moved to approve the licensing agreement as a perpetual, nonexclusive license; the motion was seconded and passed by voice vote. Commissioners asked staff to finalize the language and circulate the final agreement for signature. The county will send the finalized agreement to Nicole and Lorinda for signature processing after it is finalized.
