Shelby County delegation defeats amendment, advances SB 314 on 4-3 vote

The Shelby County Legislative Delegation voted down an amendment to Senate Bill 314 and then approved the bill itself on a 4-3 roll call Thursday, after members and staff raised legal questions about the amendment and debated funding for the sheriff’s office.

The amendment, offered during the delegation meeting, was defeated on a recorded vote after members heard that the Legislative Services Agency (LSA) had advised the amendment “will not hold up” legally. Representative Ellis, a member of the delegation, said LSA advised against the amendment and warned it “could become a problem” if readers misinterpreted its language. “They have said since then, people have questioned whether it would be actually constitutional or not,” Ellis said during the meeting.

We as a state have taken a stance on creating a fund called the fiscal permanent replacement fund, but that is sunsets,” Ross said.

After the amendment failed, the delegation took a roll call on Senate Bill 314 itself. The clerk announced the bill passed on a 4-3 vote.
