Council rezones 1.69-acre site on North Third to ‘neighborhood service’ after staff negotiation

The City Council voted 4-0 to approve an ordinance rezoning about 1.6938 acres at 1818 North Third from a mix of general retail and single-family to a classification that staff and the owner agreed would be “neighborhood service.”
City planner Mister Chandler said the owner originally sought an expansion of general retail but staff and the Planning & Zoning Commission concluded that “neighborhood service” better fit the Garden District neighborhood plan and would reduce the likelihood of uses such as smoke or vape shops or other retail incompatible with the nearby Lamar Middle School. Chandler said water and wastewater are available and that a 6-foot sidewalk would be required with future development; he also noted the city had received TxDOT approval to submit a grant application to fill sidewalk gaps along Third Street.
Seventeen notices were mailed to adjacent property owners; staff reported no responses. Chandler said the owner agreed to the neighborhood-service classification and that the preliminary plat process is moving forward concurrently. Mayor Pro Tem Tim Walker moved to approve; Council member Grant seconded. The motion passed 4-0.
