Kenai Peninsula Borough Plat Committee members met and on record approved preliminary plats for Heron Subdivision, Killeen Kasidloff Preservation Estates, Canice (Canice/Canite) Estate Subdivision, Black Gold Estates replat and Earlene Subdivision Number 4; the committee also approved the consent agenda (which included the E34 Snow subdivision replat). Myers Estates (KPP file 2025-032) was postponed at the applicant's request.
The approvals were generally unanimous and were made "subject to staff recommendations and compliance with KPB code," with staff repeatedly asking the committee to adopt and incorporate the staff report and recommendations by reference. Several plats included requests for exceptions to Kenai Peninsula Borough (KPB) code provisions (most commonly the lot-dimension 3:1 depth-to-width ratio or block-length limits); the committee voted separately on each exception and granted the requests after staff recommended approval.
Why it matters: Preliminary plat approval allows applicants to proceed with final survey work, engineering and conditions identified by staff (for example, soils reports where required, showing utility easements, and flood-hazard notes). Several parcels face physical constraints such as proximity to the Kenai River, Pollard Lake or existing road and lake boundaries that limit compliance with KPB block-length and lot-dimension standards; the committee's concurrence on exceptions recognizes those constraints while attaching staff conditions for final plats.
Most important details and outcomes
- Consent agenda: The committee approved the consent agenda, which included the minutes from the April 14, 2025 plat committee meeting and a grouped plat identified in the packet as E34 Snow subdivision (2020-5 replat). Roll-call votes on the consent agenda were recorded as Commissioner Morgan: Yes; Commissioner Venetti: Yes; Commissioner Whitney: Yes; Commissioner Gillum: Yes.
- E1 Heron Subdivision (KPP file 2025-049): Staff reported the project would subdivide a 12.715-acre parcel into several lots including a lot below 200,000 sq ft that will require a soils report and engineer signoff. Staff noted existing well and septic features and recommended the surveyor watch for encroachments and show them on the final submittal. The surveyor requested an exception to KPB 20.30.190.A (lot-dimension 3:1 ratio); staff recommended granting the exception and the committee voted to grant it. The preliminary plat motion passed on roll call (Morgan: Yes; Venetti: Yes; Whitney: Yes; Gillum: Yes).
- Myers Estates (KPP file 2025-032): At the surveyor's and applicant's request the item was postponed pending further review; staff made no decision and there was no public testimony or committee action beyond noting the postponement.
- Killeen Kasidloff Preservation Estates (KPP file 2025-050): The proposal would combine four parcels to create a 5-acre lot and a ~101-acre tract intended to preserve shoreline around Pollard Lake. Staff noted mixed wetlands and timber on the site, identified access via Polar Loop Road and Reindeer Lane, and that a block-length exception to KPB 20.30.170 was requested because portions of the proposed tract exceeded the maximum block length. Staff recommended the exception and recommended approval of the preliminary plat subject to staff conditions; the committee granted the exception and approved the preliminary plat on roll call (Morgan: Yes; Whitney: Yes; Venetti: Yes; Gillum: Yes).
- Canice Estate Subdivision (KPP file 2025-017R1): Staff reported the replat would create four new lots (roughly 1.05 to 1.24 acres) with legal access along King Salmon Avenue and noted the property is within a FEMA-designated flood hazard zone and floodway. Staff recommended carrying forward FEMA panel and flood-zone notices and showing habitat-protection lines on the drawing; soils reports and an engineer's signature will be required because the new lots are below 200,000 sq ft. An exception to KPB 20.30.190.A (lot-dimension 3:1) was requested and recommended by staff; the committee granted the exception and approved the preliminary plat (Morgan: Yes; Whitney: Yes; Venetti: Yes; Gillum: Yes).
- Black Gold Estates replat (KPP file 2025-048): The plat consolidates four lots and finalizes the vacation of an unnamed frontage road adjacent to Lots 11 and 12, Block 8, and vacates two 10-foot utility easements at the back of parent lots. Staff reported the city of Kenai planning and zoning commission reviewed and recommended approval and noted the parcel is in FEMA Flood Zone D (undetermined). City water and sewer are available, and city staff indicated a soils report would not be required. The committee approved the preliminary plat on a unanimous roll call (Morgan: Yes; Whitney: Yes; Venetti: Yes; Gillum: Yes).
- Earlene Subdivision Number 4 (KPB file 2025-047): The action finalizes the vacation of a portion of Erlewine Road, realigns three lots and will create three new lots sized about 2.36, 2.57 and 2.68 acres. Finalization is contingent on the planning commission's approval of the road vacation and subsequent assembly consent. The river center reviewer identified the plat as within FEMA flood-hazard Zone X (non-regulatory); staff asked that the flood-hazard notice include FEMA panel and zone. An exception to KPB 20.30.190.A for lot-dimensions (3:1) was requested for two lots, staff recommended granting the exception, and the committee voted to grant the exception and approved the preliminary plat (Morgan: Yes; Whitney: Yes; Venetti: Yes; Gillum: Yes).
Public comment and testimony
Public testimony was minimal across items. One member of the public spoke during the Earlene Subdivision item: Gary Davis, 39401 Sterling Highway, an owner of one of the lots involved, asked that an existing plat note be carried forward to the new plat. Davis said, "Any plat note that's on the previous plat needs to be carried forward to this plat." Staff acknowledged the request and indicated existing notes would be carried forward as appropriate.
Distinguishing discussion, direction and decisions
- Discussion: Staff presented the technical findings and constraints for each plat (soils-report triggers, FEMA/flood notes, utility easements, block-length and lot-dimension constraints). Commissioners asked routine clarifying questions (for example, confirming whether an easement or road name on a plan matched the staff report) but there was no recorded substantive dissent.
- Direction: Staff repeatedly requested that final plats include specific notes and labeling (e.g., FEMA panel and flood-zone designations, utility-easement flags, and encroachment notations) and asked the committee to adopt staff reports by reference.
- Formal actions: The committee recorded motions and separate votes on each requested exception and on each preliminary-plat approval. Except where an item was postponed (Myers Estates), every motion to grant preliminary approval and every separate exception vote passed unanimously per the roll-call tallies recorded.
Meeting close
The committee opened a public-comment period for items not on the agenda, received no comments, and adjourned the meeting. The transcript shows the plat committee moved to adjourn after the items above and closed the recorded session.
