The South Salt Lake Planning Commission on April 17 unanimously approved a preliminary plat to consolidate two parcels at 3535 South State Street into Mark Miller Subaru’s existing lot and approved an amendment to the dealership’s conditional use permit to add the new property with updated conditions.
Staff described the request as two linked applications: a preliminary plat to consolidate the Wilmore property into the existing dealership plat and a conditional use permit amendment (C250003) to ensure the newly added property is covered by the dealership’s existing CUP conditions (C19-0013) plus several additions.
Planner comments and the applicant’s presentation said the site previously contained three houses; one was renovated and placed back on the market, one had been demolished after testing showed methamphetamine contamination above Utah’s remediation threshold, and a third will be sold. Applicant Josh Goldsmith, chief operating officer for Mark Miller Subaru, said the firm tested both homes when it bought them, invested about $60,700 to rehabilitate the home that will be sold, and demolished the contaminated house after remediation and structural concerns made repair impractical. He told commissioners the contaminated house tested at 0.27 micrograms per square centimeter (reported as 0.27 in the meeting), above the state’s 0.1 threshold mentioned in the hearing.
As part of the consolidation, staff said the applicant will provide sidewalk and park-strip improvements along Winslow Avenue, meet a previously required 15% landscaping minimum when final permits are pulled, and dedicate 11.5 feet of right-of-way while maintaining a 10-foot public utility easement. Staff recommended approval of the plat and the CUP amendment with updated conditions that include maintaining an eight-foot fence and landscape buffers where the dealership abuts single-family uses.
Goldsmith told the commission the dealership intends to use the newly consolidated parcel to create community amenities, including a roughly 20-by-40-foot dog park for customers and potentially the public, and future open-access level 3 electric vehicle fast chargers. He said a fenced dog park lowers liability compared with a playground and would be open 24/7 if approved and permitted by the city. Staff said accessory uses such as a dog park would be analyzed as part of the CUP review; additional approvals and neighborhood comment could be required depending on the scope.
Commissioner Peschman moved to approve the preliminary plat to consolidate two properties into one lot at 3535 South State Street; Commissioner Holscher seconded. The motion passed unanimously.
Commissioner Southie moved to approve the amended conditional use permit C250003 for Mark Miller Subaru, clarifying that an eight-foot fence (not ten feet) will be required where the property abuts single-family homes; Commissioner Spencer seconded. The motion passed unanimously.
No members of the public spoke on either item during the public hearing. Staff noted the dealership had come into compliance with earlier CUP conditions, including shielding lights and closing nonconforming curb cuts.
