Elbert County commissioners approve WF Real Estate rezoning for 40-acre parcel

Elbert County commissioners on April 23 approved a request to rezone a roughly 40.1-acre vacant parcel (case RZ2024-0023) from Agriculture to Residential-Agriculture (RA).
The application was presented to the board by Kelsey Lanham, a land use planner with Elbert County Community and Development Services. Lanham told commissioners the subject property (parcel number 64251-00-023) has no structures, is just southeast of the Sun Country subdivision, and is outlined in the applicant’s exhibits. She said the applicant, John Wilson, requested the full parcel be rezoned to RA and that the application met the county’s noticing requirements and the review criteria in the Elbert County Zoning Regulations.
The planning staff report and Lanham’s presentation concluded the proposal met the rezone criteria in Elbert County Zoning Regulations Article 3.C.4, including consistency with the comprehensive plan, compatibility with surrounding land uses, and lack of adverse impact to public services and the environment. Lanham recommended approval with the conditions in the staff report: removal of public hearing signs within two weeks of final action, payment of fees and recording of the rezone exhibit before it becomes effective, and recordation of all documentation within 180 days of BOCC approval.
At the Planning Commission hearing earlier in April, the commission recommended approval 9–0 with conditions, Lanham said, and there was no public comment at that hearing. During the BOCC hearing one resident, Beverly Durant of Kiowa Bennett Road, spoke and raised concerns about road conditions and sight lines; she later said she was unsure whether her comment referred to this parcel because the application has no street address. The applicant, John Wilson, attended and declined to make additional remarks beyond answering questions.
After a brief discussion and no additional public comment, a commissioner moved to approve RZ2024-0023. The motion passed and the board closed the public hearing on the item.
The approval is subject to the conditions Lanham listed. The rezone will not become effective until required fees are paid, conditions are met and the rezone exhibit is recorded.
