Collin County to revise draft policy on opposing municipal utility/management districts after commissioners raise road-maintenance concerns

County staff presented a proposed resolution to formalize how the commissioners decide whether to oppose or offer non-opposition to municipal utility districts (MUDs) and municipal management districts (MMDs). Russell Schauffner, the county’s deputy county administrator, told the court the draft would codify historical practice, require supplemental contracts for police, fire, emergency services and animal control within a district, and add administrative monitoring of MUDs created through the Texas Commission on Environmental Quality (TCEQ).
Commissioners focused discussion on street and road maintenance powers sometimes assumed by districts. One commissioner said the county should “look to the MUDs to basically maintain their own streets,” adding that many MUDs seek road powers and retain roads to avoid county maintenance costs. Commissioners discussed performance bonds on roads — staff stated a typical performance requirement is two years — and questioned how the policy would affect districts that seek county acceptance of roads built to county standards.
After discussion, the court agreed to pull the draft policy for one week so staff could add language reflecting the court’s direction on roads and related authorities and return the item for further consideration.
No formal vote on the draft policy was taken at the meeting; the item was removed from consideration for revision and return.
