Commission backs rezoning to allow second single-family residence at 2225 Kansas Road

On May 1 the Area Plan Commission voted 8-0 to recommend that 2225 Kansas Road be rezoned from R1 to R3, with a use-and-development commitment limiting development to two single-family residences on the 9.78-acre parcel.
The petitioner, represented by Matt Layman of R. Layman and Son Consulting, told commissioners he will file a UDC that explicitly limits the parcel to two single-family homes and prevents other residential or commercial uses from being added. Planning staff reminded the commission that recent changes to the county zoning code also allow an accessory dwelling unit (ADU) up to 40% of the size of the existing residence or the option to complete a subdivision without rezoning; Layman said the owners opted to pursue rezoning while keeping the property intact.
Commission discussion noted that new lots in an R3 zone must have at least 20 feet of frontage on a public street and that residential structures may occupy up to 75% of a lot area. Commissioners also clarified that, if the owners later subdivide, they would still need to comply with zoning and would likely need a further rezoning to market houses individually.
A motion to approve the rezoning with the UDC passed on roll call with the following yes votes: Mister Nicks, Mister Petke, Mister Shetler, Mister Walters, Miss Cobble, Miss Freeman, Mister Gable and Miss Stevens. The commission recorded 8 yes, 0 no, and will forward its recommendation to the county commissioners for final action.
