The Area Plan Commission on May 1 voted unanimously to continue consideration of a rezoning request for 5001 Hirsch Road and waived the filing fees so the applicant can confer further with neighbors and refine the petition.
The petition (REZ-2025-011R) seeks to rezone the property from R1 to C4 with a use-and-development commitment to allow indoor and outdoor storage. Planning staff reported the acreage is in a predominantly mixed agricultural and residential area and that the 2035 future land use map recommends residential use for the site; staff noted the requested commercial designation would not be consistent with the comprehensive plan.
Jeremy Schneppner, representing the petitioner, said he had spoken with an adjacent property owner about drainage, privacy buffering and pedestrian infrastructure, and that the neighbor had expressed concerns but not formal opposition. Commissioners and staff noted the UDC submitted at filing mirrored the UDC used on an adjacent property and included multiple commercial uses that the petitioner said were not his intent; Schneppner agreed to remove extraneous uses.
Commissioners discussed the option to continue the petition so the applicant and neighbors could work out development standards and buffering. The commission voted 8-0 to continue the item to the June 5 meeting and to waive the fees for that continuance. Roll call recorded eight yes votes and no negatives. The commission record indicates the petition will return to the June 5 APC meeting for further consideration.
No formal development commitments beyond the proposed UDC were recorded at the May hearing; staff noted portions of the site lie within a 100-year floodplain and that the request is inconsistent with the comprehensive plan’s recommendation for residential uses in this corridor.
