Representative Michael Pressell told the committee that the conference committee report “reflects, actually taking out 2 pieces of legislation that were put into, 73 on the House side. The first piece was making it illegal to advertise an illegal substance in the state of Indiana. The second piece dealt with predatory towing. Both of those have been removed, and Senate Bill 73 looks exactly like, what it came from the senate as now.”
Pressell said the two provisions removed from SB73 were placed in a conference committee report for House Bill 1390. “So those were provisions that were actually put in in the Senate also in 1390. But due to Germaine rules, they had to come out of 1390. So they were in '73, and now they're back in 1390 where they belong,” he said.
On the bill’s trailer-related provisions, Pressell said current statute in Title 8 groups trailer dealers with auto dealers, which typically requires a physical dealership. The change in SB73 would allow retail chains and other nontraditional sellers to sell utility trailers without a physical dealership. Representative Brandon Pierce asked for a brief overview of the policy goal; Pressell said the change addresses manufacturers and sellers in places such as Elkhart where many trailer manufacturers do not have traditional dealerships.
Representative Shawn Slager moved to suspend House Rule 153.1 so the conference committee report for Senate Bill 73 be eligible for consideration after April 15, 2025, and to amend House Rule 155.1 so the conference committee report may be provided for member distribution and held for 15 hours. The motion was seconded and passed on a roll call vote of 8-0, with Representatives Baird and Johnson recorded as excused.
