After public comment and split views, court reinstates Memorial Day fireworks sales in Kaufman County

Kaufman County Commissioners Court voted to allow fireworks sales on Memorial Day in addition to the sales already permitted under state law for July 4 and New Year’s Day, after public comment from vendors and a presentation by the county fire marshal.

Mary Willard, a local fireworks vendor, urged the court to allow Memorial Day sales, saying lost Memorial Day sales had affected her cash flow in prior years. “A couple of years ago, we were denied the ability. To this day, my cash flow is still affected by that season being gone. It is a major holiday for us,” Willard told the court.

Fire Marshal Mike reported that the county’s inspections and safety outreach have coincided with few reported fireworks-related fires or injuries in recent years. “Last year, we had no reported fires nor reported injuries that came through,” Mike said, and he described “pop-and-park” sites — vendor-operated pop-up areas with attendants, signage, shovels, fire extinguishers and water — as a harm-reduction practice that some vendors have used successfully.

Commissioners discussed competing concerns: several said Memorial Day is a day of remembrance and expressed personal reservations about permitting fireworks that day; others highlighted vendor livelihoods and the risk that residents would travel to neighboring counties to buy fireworks if Kaufman County did not permit sales. One commissioner noted a pending state bill that could eliminate counties’ discretion over fireworks sales.

After discussion and public comment, the court took a voice vote to allow fireworks sales on Memorial Day. The motion carried. Commissioners and vendors emphasized encouraging use of designated “pop-and-park” locations to reduce injuries and roadside discharges.
