The Planning and Zoning Commission voted 6-0 to approve a preliminary plat replat of the Shops at Lake Havasu City (Tract 2396 A) at 5601 Highway 95 North, creating 10 individual lots and a common Parcel A for shared parking.
Staff presented the plat and recommended approval with conditions addressing building‑code compliance arising from the new property lines. The staff recommendation required that a building code compliance covenant be placed on the dedication page of the final plat and stated that because the new property line reduces the required 60‑foot yard in one location, one‑hour fire barriers will be required between tenant spaces. Staff explained the condition as: "Provisions for the open mall buildings and anchor buildings shall be maintained as required by the International Building Code...1 hour fire barriers are required between all tenant spaces in all buildings due to a reduction of the required 60 foot yard." Applicant Lee Johnson said the replat breaks the large mall property into individual ownership parcels while retaining Parcel A as common parking. He described the history of prior parcel splits and said the parking remains common and the city will still require maintenance of overall parking counts when building changes occur.
Commissioner Chad Nelson moved to approve the preliminary plat and specifically included the building code compliance covenant in his motion; Commissioner John Kendig seconded. The motion passed 6-0. The staff conditions, as approved, require the covenant on the final plat dedication page and call out the International Building Code provisions and one‑hour fire barriers between tenant spaces where the 60‑foot yard is reduced. The commission’s approval advances the plat toward final plat recording and any required building code compliance actions.
