The Madison Plan Commission on Monday approved an amendment to a plan development district and related conditional uses to permit a restaurant/nightclub and amplified outdoor sound at 8216 Watts Road, subject to several conditions intended to limit impacts to nearby residents.
Planning staff told the commission the property previously had been approved for a winery and an outdoor eating area; the current request would amend the zoning text to make outdoor amplified sound a conditional use and would allow conversion of the winery into a restaurant/nightclub. Staff said the outdoor eating area is about 375 square feet and sits approximately 160 feet from the nearest residential units across a parking lot. Given that separation and the surrounding commercial context, staff concluded the standards for conditional use could be met if conditions were attached.
Key conditions the commission included: amplified outdoor sound must end by 9 p.m.; amplified events should be limited to two days per week initially; amplified sound may not begin Monday–Friday before 5 p.m.; and the outdoor eating area’s amplified-sound approvals will be subject to continuing jurisdiction, allowing the commission to revisit the approval if complaints arise. Staff recommended an initial limit with the option after six months for an administrative minor alteration to consider additional events, contingent on demonstrated performance and complaint history.
Public comment and applicant response: Tim Mulcahy, representing Brennan’s Market and the applicant, told commissioners he expected at most one or two events per week and that he wanted to be "good neighbors" to nearby apartments and a health-care provider. Commissioners asked whether limiting amplified sound to evenings would address potential conflicts with a nearby health-care facility; Mulcahy responded that he did not expect amplified sound during regular daytime business hours and said Thursdays–Sundays evenings were the likeliest windows for music.
Why this matters: The approval shows the commission balancing economic activity and neighborhood livability; the property is in a shopping-center context and staff concluded the relative separation from housing and the planned conditions made approval acceptable.
Outcome and implementation: The alteration to the specific implementation plan and the conditional-use approvals passed by unanimous voice consent. The conditions attached by the commission include a 9 p.m. cutoff for amplified sound, a two-event-per-week limit (with a six-month administrative review possibility to amend), and a restriction preventing amplified sound Monday–Friday before 5 p.m. The Planning Commission retains continuing jurisdiction to revisit the approval if complaints emerge.
