The Workforce Commission (TWC) considered multiple matters on docket 18 during its meeting, including one tax-liability case, wage-claim dispositions and a series of unemployment insurance (UI) appeals that commissioners resubmitted, affirmed or ordered reheard.
Commissioners agreed with staff recommendations on the single tax-liability case listed on docket 18 (case number TDDash24Dash057Dash1124) and concluded that matter without further discussion. They also voted to accept staff recommendations on the remaining wage-claim cases on docket 18, with several commissioners noting exceptions recorded on a short-form dissent list.
Why it matters: outcomes in these UI determinations affect whether employers’ accounts are charged (chargebacks or reimbursements) and whether claimants remain eligible for benefits. Resubmissions and rehearings can delay final resolution and affect employers’ accounting and claimants’ access to benefits.
Commissioners debated a series of UI case appeals pulled for additional discussion. For some cases, the panel explicitly voted to resubmit the appeal for further proceedings; for others it affirmed or modified the appeal tribunal’s (AT) decision, and in at least one pulled case the commission ordered rehearing. Several commissioners differed on whether claimants had established "good cause" for missing hearings or whether employer evidence showed misconduct connected to work.
Votes at a glance
- Tax liability: TDDash24Dash057Dash1124 — commissioners "agree with the recommendation" (staff recommendation accepted). No further action recorded.
- Wage claims, docket 18 — motion to accept staff recommendations on remaining wage-claim cases passed, with exceptions noted on the wage-claim short-form dissent list.
- UI case 3419394 — commission resubmitted the case for further proceedings (resubmit).
- UI case 3432029 — commission resubmitted the case for further proceedings (resubmit).
- UI case 3658750 — commissioners affirmed the AT decision and instructed that the employer be billed ("Affirm the AT, bill reimbursing employer").
- UI case 3672804 — commissioners instructed a modification of the AT decision (outcome recorded in the transcript as "valid claim, misconduct, reimbursing employer not billed, adequate employer response").
- UI case 37990 (PIP 0) — the commission voted to rehear the case; the transcript records "We will rehear the case." This was the last pulled UI case discussed.
Several other pulled UI appeals drew extended debate on whether claimants had good cause for nonappearance and whether employers produced adequate, firsthand testimony alleging misconduct. In multiple instances commissioners split on credibility findings and evidentiary weight; the transcript records at least one instance in which the panel did not achieve a majority vote on the disposition of a pulled case.
At the close of the docket-18 review, the commission moved and approved the staff recommendations on the remaining UI cases on docket 18, with dissenting exceptions preserved on the UI short-form dissent list.
Speakers who spoke to docket 18 matters included Chairman Daniel; Commissioner Esparza; Commissioner Trevino; and various staff members and presenters who identified themselves by role in the record. Commissioners used the commission’s short-form dissent lists to record exceptions to the majority rulings.
Ending: The commission recessed after completing agenda items 1 through 8 and before moving to agenda item 9. Several matters from docket 18 were resubmitted or scheduled for rehearing, which will return to the commission’s calendar for further proceedings.
