The Del City City Council voted April 21 to assess $4,619.54 in abatement costs to the owner of 4415 East Reno for cleanup of code violations after a public hearing during its regular meeting.
The council’s action followed a presentation from Andrew Myers, city planner, who said the property had generated 27 code cases since the owner took possession and that the city received two bids for the cleanup; the low, responsive bid totaled $4,619.54. The property owner’s company was identified in the hearing record as Classic Crafts Incorporated.
Owner Billy Smith told the council he removed some items but that freezing weather in February, his wife’s upcoming surgery and limited opportunity to work outside hampered efforts to comply in the weeks before the abatement. He said some items were being stored temporarily for reuse and that he felt he had not been given adequate opportunity to request additional time. Beverly Smith, who also spoke, said she had tried to call and leave messages about the family’s situation and did not receive a timely callback.
Myers and other staff described the municipal abatement process and said the city provided the ten-day notice required by code before abating the site. Myers said the low bid for the work was selected as the most responsible option after two bids were obtained and that the property had a long code history.
After the public comments, the council voted to approve and ratify the assessment in the amount of $4,619.54. The vote recorded: Councilman Tatum — yes; Councilman Dean — yes; Councilwoman Finch — yes; Councilman Brown — no; Mayor — yes. The motion carried.
The assessment will be placed on the property record according to Del City procedures; staff did not identify subsequent collection steps beyond the assessment during the meeting.
The council’s discussion distinguished between the city’s legal authority to abate after notice and the owner’s claims of hardship; staff said due process (the 10-day notice) had been met.
