Planning commission approves temporary landscape-materials site at 2367 N. U.S. 89 with staff review of temporary office

The Pleasant View Planning Commission approved a site plan for a permitted temporary commercial use at approximately 2367 North U.S. Highway 89 but attached a condition requiring staff review of any proposed temporary office structures.

Tammy, planning staff, presented the application as a proposal for a seasonal landscape materials business on a vacant lot along Highway 89. Tammy told commissioners the petitioner had obtained required access approvals from Utah Department of Transportation and had met the Development Review Committee’s engineering conditions. Staff recommended approval of the site plan.

The petitioner, Rex Whitaker (33 73 North 700 West), told the commission he intended to use the site seasonally to sell bark and similar materials. Whitaker said he might “put a trailer like an office trailer there or something” to serve as an on-site office. Commissioners and staff raised questions about whether an office trailer or shed would be allowed and whether that would fall under building-permit, business-license, or site-plan review.

Commissioners agreed to approve the site plan with a condition that staff review any temporary office structure prior to issuance of business licenses or building permits. The commission’s approval requires the petitioner to obtain a temporary business license each year if he intends to operate seasonally and to comply with any city code limitations on nonpermanent structures.

The commission’s motion passed with a second from Commissioner Gosner and no recorded opposition. Staff will confirm whether a temporary office trailer or shed is permitted under the city’s ordinances when issuing permits and licenses.
