Public Service Commission votes to publish consolidated-billing regulations for community solar subscribers

The Public Service Commission voted to publish new regulations that would govern consolidated billing for subscribers to community solar generating stations during a rulemaking proceeding on Rulemaking 56. Chair Hoover moved to publish the new chapter and regulations and the motion passed with recorded aye votes from Commissioner Linton, Commissioner Sushman and Commissioner Richards.
Staff members Annette Garofalo and Philip Vanderhaden presented the rules on behalf of Commission staff. Garofalo told the commission the rules were “consistent with commission direction and were composed by the Net Metering Working Group.” Vanderhaden, facilitator of the Net Metering Working Group, said the draft is “a single chapter of new regulations which are intended to implement the consolidated billing feature which is required by our net metering law.”
The staff presentation described the regulations as a consensus product of the working group and said the rules are intended to be implemented through tariffs that utilities will need to file and put into effect by the end of this year. No commissioners asked questions during the proceeding, and the commission chair asked whether any members of the public wished to comment; none did.
The motion approved the addition of a new COMAR chapter, 20.62.06, and four new regulations: COMAR 20.62.0601, 20.62.0602, 20.62.0603 and 20.62.0604. The motion specified publication in the Maryland Register for notice and comment and allowed non-substantive changes necessary to conform to COMAR drafting requirements.
The commission did not record any amendments or conditions to the regulations beyond the drafting-conformance allowance. Next steps, as stated by staff, include the filing of tariffs to implement the regulations and the Maryland Register notice-and-comment period required for new COMAR rules.
