Conroe IDC directs city attorney to research foreign-trade subzones outside city limits

The Conroe Industrial Development Corporation voted to direct the city attorney to research and draft a legal opinion on whether the City of Conroe has the authority to grant foreign-trade subzones (subzones of the city’s foreign-trade zone) outside the city limits or outside the city’s extraterritorial jurisdiction (ETJ).
The motion asked the city attorney to return a written opinion for review by the city council and the foreign-trade zone board. Board members said the request was limited to a legal determination and not approval of any particular subzone application. Several directors urged caution about routinely authorizing zones outside the city and described the measure as a potentially one-time, limited tool; staff and the city attorney said any particular application still would require further review and approvals, including by City Council. Board members said they had not previously authorized free-trade zones outside the city or the ETJ, and staff described the request as exploratory.
The motion passed on a voice vote. The board convened into executive session earlier in the meeting under Texas Open Meetings Act sections 551.087 (economic development), 551.072 (real property), 551.071 (consultation with attorney), and 551.074 (personnel), and reconvened to take the direction to prepare the opinion.
