Commissioner Nicole Wilson asked the Board of County Commissioners on April 22 to withhold or delay the reappointment of Peter Fleck to the Orange County Environmental Protection Commission (EPC), citing public concern and ongoing litigation related to a private dock and boathouse permit for property owned by Fleck.
Cheryl Gillespie, who manages advisory board appointments and the MMRB process, told the board that Fleck met the qualifications for the regulated business/municipality category and that he had originally been appointed in October 2021. Wilson said her concern was that the litigation and permit matter could affect the public's perception of the EPC’s impartiality when that advisory body reviews permitting and environmental evaluations. Wilson noted Fleck has withdrawn from votes in the past where he had clear conflicts but said the pending private litigation raised enough concern that the board should delay action so the candidate could respond and the public record could be reviewed.
After discussion the board voted unanimously to continue action on Peter Fleck’s reappointment to allow him the opportunity to respond and for staff to provide further information. The board approved the other reappointments on the consent agenda.
