The Town of Carbondale Board of Trustees voted unanimously April 22 to approve a right-of-way lease renewal with the Lions Plaza Condominium Association, increasing the rental payment by $100 and extending the lease term to 30 years while retaining a clause allowing the town to terminate the lease with 30 days' notice.
Town staff said the lease had been in place since 1996, was last renewed in the 2000s, and that the association had continued to make payments after a prior expiration. Kevin (public works/staff) told trustees the longer term was intended to reduce administrative lapses from frequent renewals but would not restrict the town's ability to use the right-of-way: "This is actually a 30 year lease... it doesn't change our ability to go in there with 30 days notice and use the right away for anything we want to."
Trustees discussed whether the town should charge a rate aligned with inflation or treat right-of-way leases as token acknowledgements when private development uses public land. Trustee Ross asked whether the association or adjacent owners were charging tenants for parking; staff said they had no information that a sublease-for-parking arrangement existed. Trustees also raised pedestrian and bicycle infrastructure concerns near the strip and noted possible future tactical urbanism or a widened sidewalk as Main Street development continued.
Trustee Jess moved to approve the lease and authorize the mayor to execute it; Trustee Ross seconded. The motion passed with all trustees present voting in the affirmative.
