Wyoming council amends pilot property tax-exemption rules after debate over "two-project" limit

The Wyoming City Council voted April 21 to amend Chapter 2, Article 4, Division 3, Section 2-283 of the city code to finalize procedures and standards for evaluating requests for property tax exemptions tied to pilot projects.
Council members debated a sentence in the ordinance that read, “There shall be no more than 2 projects with active service charge in lieu of property taxes within half a mile of each other.” Council Member Posler moved to remove that sentence; the amendment was seconded and carried. The council then voted to adopt the ordinance as amended.
The dispute centered on whether the existing language unambiguously allowed exceptions for additional projects in a compact downtown corridor. Council Member Hill voted against the amendment, saying the wording as written appeared to be a firm cap. Other members said staff intended the ordinance to provide flexibility and that minor wording changes could clarify that intent. City staff offered to revise language to make discretion explicit if council preferred.
City staff described the ordinance as providing “standards of review” for pilot projects, including criteria the council should consider if a proposed project lies close to previously approved projects. The ordinance had been discussed at a March work session and came to the council in final reading on April 21.
The council recorded the roll call on the motion to amend and on final adoption. On the amendment vote the roll call was: Council Member Posler — yes; Council Member Postma — yes; Council Member Brethauer — yes; Council Member DeKreger — yes; Council Member Hill — no; Mayor — yes. The motion to adopt the ordinance as amended also passed on a roll call vote with the same configuration reported in the meeting record.
The newly adopted language directs that when a project is within a specified distance of a previously approved pilot project, council shall apply the enumerated criteria before approving another project; staff said the change removes the hard numeric cap while retaining review standards. Council directed staff to finalize wording that makes the intended flexibility clear before publication of the amended ordinance.
The council moved on to other business after the vote; no separate motion was recorded to postpone or table the ordinance.
