Hall presented an expert opinion that certain ground‑level patios and private open‑space elements did not meet the dimensional or enclosure requirements the appellant cited.
The applicant’s counsel, Jackson McNew, urged the committee to defer to the Planning Commission’s prior 5‑0 finding and noted the record showing the site meets massing, transit proximity and other zoning requirements. Staff confirmed that the project was found within 1,500 feet of transit routes cited in the record and described the administrative review and conditions applied to the project.
After public comment and discussion, the committee voted to deny the appeal and uphold the prior exemption and approvals. The roll call recorded unanimous support for the staff recommendation.
