Kern LAFCO approves City of Delano annexation for sewer farm

On April 16, 2025, the Kern Local Agency Formation Commission approved the City of Delano’s application to annex property the city purchased to expand its sewer farm, citing the limited-purpose annexation provisions described by staff.
Executive Officer Bud Knox told the commission the annexation falls under Government Code section 56,742 (staff corrected an earlier mis-citation to 56,743). He said the code allows a city to annex county property it owns and uses solely for municipal services, and that for wastewater-treatment uses the statute imposes no size limit but does set conditions on future uses and transfers.
Knox recommended approval with the statutory conditions: the annexed parcel must be located within the same county as the city, remain city-owned and used only for municipal services, and revert to unincorporated county jurisdiction if the city sells it or otherwise ceases the permitted use. Knox also noted the statute bars using the parcel’s annexation to pull in non–city-owned properties to make boundaries contiguous; leasing for electrical services is allowed but development such as shopping centers or hotels is not.
No members of the public spoke on the item. Commissioner Couch moved approval; the commission recorded unanimous votes in favor and the motion passed.
The commission’s action approves Annexation No. 1852 subject to the conditions described under Government Code section 56,742; if the property ceases to meet those conditions the city must adopt a resolution confirming detachment and the property would revert to county jurisdiction.
