Sarpy County renews special-use permit for concrete/asphalt recycling, approves five-year road-maintenance deal

The Sarpy County Board of Commissioners approved renewal of a special-use permit and a related road-maintenance agreement Tuesday that affect a concrete and asphalt recycling operation southwest of 111th Street and Mitchell Road.
Robert Lirocco, Sarpy County planning director, told the board the application had been tabled at the July 29 meeting so the applicant could coordinate a road maintenance agreement with the county. Lirocco said staff recommended approval of the renewal with updated conditions and a sunset provision.
The board approved the special-use permit renewal for Silex Group LLC with a term that will expire Dec. 31, 2030. Conditions include providing copies of any applicable permits obtained during the permit term, addressing comments from reviewing agencies, and continued cooperation on gravel-road maintenance, Lirocco said.
Pat Sullivan, attorney for Silex, told commissioners the applicant had resolved internal issues and appreciated the county’s patience. “I appreciate not only the staffs, but the commissions, indulgence and patience on this,” Sullivan said.
Separately, the board approved a five-year road maintenance agreement (Resolution 2025-221) between Sarpy County and Silex Group LLC, presented by Deputy County Attorney Nicole Spitzenberger. The agreement requires the applicant to pay for road maintenance equal to the lesser of actual total cost or a baseline amount beginning at approximately $11,600 with a 3% annual escalator over the five-year term; the agreement also rolls in roughly $11,000 from the prior (2019) agreement each year, Spitzenberger said.
Both the special-use permit renewal and the road-maintenance agreement were approved by motion (Special-Use Permit: motion by Commissioner Mixon, second by Commissioner Warren; Road Maintenance Agreement: motion by Commissioner Warren, second by Commissioner Mixon) and the board announced the motions carried.
No members of the public spoke on the items at the hearing. The special-use permit will be subject to the listed conditions and the applicant must supply required permits and address county and agency comments during the permit term.
