DDS outlines implementation approach for Public Records Act changes effective Jan. 1, 2026

Director Pete Chervinko told the committee DDS submitted a budget change proposal to implement the Public Records Act changes the legislature enacted last year (AB 1147) and that the requirement becomes effective Jan. 1, 2026 for regional centers. He said DDS expects to provide legal support and advice to regional centers as they think through compliance and that the department is "probably not building out an IT system at the department to support its implementation as it originally envisioned."
Chervinko emphasized privacy protections and said department practice will comply with statutes that permit individuals access to their own records while protecting identifiable personal information about others. He told the committee the department will review its original assumptions—specifically the staffing requested in the initial BCP—and expects to reexamine that request as part of the May revision.
The committee did not take a formal vote; LAO and the Department of Finance had no additional comments on the item during the hearing.
