CRA approves three Breaking Barriers grants, pauses new applications pending rule fix

Cape Coral, Fla. — The City of Cape Coral Community Redevelopment Agency on Sept. 10 approved three business incentive awards under its Breaking Barriers to Business program and moved to halt acceptance of new applications while staff returns with clearer, written program language.

The board approved CRA Resolution 14-25, a recommended $33,008.94 reimbursement for Palace Pub & Wine Bar; Resolution 15-25, a $28,520 award for Nice Guy's Pizza; and Resolution 16-25, a $7,817 award for Lady Cakes Bakery. After discussion about inconsistent eligibility language on the Economic and Business Development Office web page, the CRA also voted to suspend receipt of new B2B applications effective 11:59:59 p.m. the previous night and asked staff and the city attorney to codify the application timing in a formal resolution.

The Breaking Barriers program reimburses qualifying permit- and code-related construction and renovation costs. Andriana Peterson, the economic and business development office staff member who presented the three applications, summarized the program as “designed to assist eligible businesses and developers with costs incurred to meet the land development, Florida Building Code, and fire code requirements” and noted the grants are capped at 20% of the total investment and $50,000 for most B2B awards.

Applicants approved Sept. 10: - Palace Pub & Wine Bar — total project investment reported as $169,469; recommended award $33,008.94. Peterson identified eligible items including an ADA-compliant restroom, plumbing and electrical upgrades. - Nice Guy’s Pizza — project investment $142,602; recommended award $28,520. The application covered expansion of outdoor seating and parking-lot improvements. - Lady Cakes Bakery — total project investment $39,088; eligible award $7,817. Owner Bess Charles told the board she applied after a CRA project manager informed her of the program, and that the work included flooring, ADA-compliant restrooms and electrical and plumbing upgrades. “Not once have I been brought forth with any issues with my application,” Charles said during public comment.

Public comment and several commissioners focused discussion on a mismatch between the program’s resolution language and the publicly posted application instructions. The EDO web page states that “all incentive applications must be received and reviewed prior to the project's completion to be eligible for the grant award.” Staff acknowledged the earlier administrative practice had differed in at least one case and said the business in question had applied after receiving a final inspection and certificate of occupancy earlier in the year.

Commissioners said the inconsistency created a fairness concern. Commissioner Gunter and others urged a short pause so staff and the city attorney could amend the program language and prevent a wave of retroactive requests. The board then approved a motion directing staff to stop accepting new B2B applications while the administration prepares an “after-the-fact” resolution memorializing the board’s direction; the motion specified the suspension’s effective timestamp and that applications already properly submitted would not be affected.

The board also heard from Jay Dobson, a public commenter who urged approval of the Lady Cakes award and described the business as a “world renowned” local bakery that helps revitalize South Cape neighborhoods.

What’s next: The CRA directed staff to return with formal language resolving the discrepancy between the public-facing application guidance and the program resolution. The board set a schedule to memorialize the direction in a resolution and indicated it would consider a special meeting or place the item on the committee-of-the-whole calendar if needed to expedite the fix.
