BZA approves variance allowing replacement stair and small deck for upper-floor unit in La Paz

The Marshall County Board of Zoning Appeals approved a development-standard variance to allow a replacement entrance deck and stair that will sit 5 feet from the South Street property line for an upstairs unit at a mixed-use building in La Paz.
Petitioner Daniel Gonzales said the structure is an existing combination of residence and commercial use (the former Bowman gas station) and that the proposed work is a repair and safer replacement for an existing, improvised stair and deck. "I'm gonna relag that deck… and then just add a 4 by 38, and then the stairs come down," Gonzales said, describing the planned work and materials.
Staff reported that several nearby corner lots are built near or at the lot lines and recommended approval. The Technical Review Committee recommended approval as well. No written objections were filed, and no members of the public spoke in opposition during the hearing.
A motion to approve the variance cited the BZA’s findings regarding public health and welfare, use and value of adjacent properties, and practical difficulties created by the structure’s existing configuration. The board approved the request on a voice vote; during the roll call the members recorded votes in favor.
Permits and building inspections remain required for the work; the variance applies only to the setback portion of the request, and the petitioner said the project is limited to providing a safer, permanent egress for the existing upstairs unit.
