Marshall Council unanimously approves Independence Park roof contract with disclosure from council member contractor

The Marshall City Council unanimously approved authorization to replace the roof on the concession/bathroom building at Independence Park, awarding the labor portion of the work to James Luzinski Construction.
Preston Stendrude of the Parks Department told the council the building’s wood shakes and soffit are deteriorating and that the roof replacement is included in the 2025 budget. “The shakes would be original to the building, I believe, in 1990,” Stendrude said. He said the city solicited quotes from four contractors and received two bids and recommended the low bid for labor from James Luzinski Construction at $5,325; the city will purchase materials from a local vendor.
City staff and the attorney advised the council that the recommended vendor is a sitting council member and that the council must follow the competitive bidding laws and state conflict procedures. City staff said an affidavit of disclosure from Councilmember James Luzinski was on file. City attorney Micaiah, participating online, advised that “the council member that has a conflict should not participate in any discussions or votes on this matter,” and city staff said Luzinski was not present at the meeting.
Councilmember Craig made the motion to approve the resolution awarding the contract; Amanda seconded. The council voted unanimously to approve the contract and authorization, as required under the relevant competitive-bidding rules cited by staff.
Council staff said the project is budgeted for 2025, is below the city administrator’s approval threshold, and that the city’s practice is to replace a roof on one building each year.
The contract award covers labor only; materials will be purchased separately from a local vendor and installed by the contractor’s crew. The city said the concession building is heavily used during the baseball season and at tournaments, making both structural and appearance reasons for the replacement.
