Elkhart County commissioners approve road impact agreement and multiple consultant contracts for upcoming road and bridge work

County Attorney Steve Olson told commissioners the road impact agreement governs private landscaping and other improvements within county right of way at two cul-de-sacs on Poplar Lane and Juniper Lane. "This is when a private party has improvements within a right of way area, and we establish the parameters for which those improvements can stay within that right of way area," Olson said. The agreement requires the homeowners association to maintain and repair the landscaping, carry liability insurance, indemnify the county, remove landscaping if the county later requests it and pay attorney fees related to enforcement.
Highway Department staff also presented consultant agreements tied to previously scored letters of interest. Kyle Wagner, of the highway department, described an agreement with Lawson Fisher Associates for construction inspection on County Road 17 Phase 1 (County Road 38 to County Road 42). "This is just the agreement with Lawson and Fisher for construction inspection," Wagner said. The board approved the agreement.
Commissioners then approved an LPA consultant agreement with American Construction Point for preliminary engineering services for the Bridge 126 replacement over County Road 6. A county presenter said the bridge project is funded and that the agreements reflect awards from the LOIs that were submitted and scored.
