Commission closes hearing, issues order for Millipore Cherry Hill project with $25,000 bond

The Danvers Conservation Commission voted Aug. 14 to close the public hearing for Millipore’s proposed work at 12 and 17 Cherry Hill Drive (DEP file 14‑1438), grant a waiver for a small amount of work inside the 50‑foot no‑build buffer and issue an order of conditions that includes a $25,000 bond to ensure the plantings and mitigation are completed as proposed.
Attorney Jill Mann, representing Millipore, said the applicant provided a detailed planting plan in response to prior comments and expects planting lists to be adjusted in the field for availability. “On 12 Cherry, we have a total of 17 trees and 44 shrubs going in in the area of your jurisdiction. And then with regard to 17, we have 10 trees and 27 shrubs,” Mann said. Mark Baker of Millipore and Thad Berry of ASB answered technical questions about stormwater and parking changes.
Commissioners discussed stormwater review with the town’s engineering department. Emily (staff) and the project team reported that after extended coordination with Stephen King in Engineering, the town is satisfied with grading and contouring details that will be finalized through the required stormwater permit. The applicant and engineering staff told the commission that revised contours and slightly enlarged ponding areas would reduce peak runoff in some places by as much as half.
The commission voted to grant a waiver allowing approximately 58 square feet of work inside the 50‑foot no‑build zone, to close the hearing and to issue an order of conditions for DEP 14‑1438 on the condition that the applicant post a $25,000 bond to guarantee completion of work and plant survivability. Commissioners said they and staff will perform periodic inspections during construction and that final stormwater management permit approval must be secured as part of the implementation.
The order was adopted by voice vote; commissioners present voted in favor. The motion and bond condition were recorded in the conservation record for DEP 14‑1438.
