Emmons County public hearing surfaces safety, tax and zoning concerns over NextEra battery project

NextEra Energy Resources representatives presented plans for a 140‑megawatt, 4‑hour battery energy storage system they call Emmons Logan Energy Storage during a public hearing before the Emmons County Commission. Company officials said the project would occupy about 24 acres adjacent to an existing five‑acre collector substation and would connect to the grid at the Napoleon substation.
NextEra project developer Clint Sherr said the company is seeking county approval of a conditional‑use permit to “construct, own, and operate a battery energy storage system called Emmons Logan Energy Storage,” and described an expected construction start in May 2026 and commercial operations targeted for December 2026. He told commissioners the company expects roughly 150 construction workers during the build and one to three full‑time operations jobs afterward. Sherr said a third‑party economic consultant estimated the project’s local property tax yield at about $7.2 million over the life of the facility. He also said the total project capital cost is roughly $180 million.
The panel’s technical presenters described the facility and its safety systems. Evan Shea of NextEra’s storage integration team explained that the system would charge from the grid when supply is plentiful and dispatch energy when it is needed, functioning in practice like a grid‑side transmission facility with the added ability to store energy. Safety lead Josh Adams said NextEra designs sites to follow the International Fire Code and NFPA 855 standards and described layers of protections including containerized battery racks, thermal‑runaway detection and remote supervisory control and data acquisition (SCADA) monitoring tied to a 24/7 renewable operations control center.
Project details presented at the hearing included a planned initial layout of 138 battery containers and 46 inverters, with an augmentation plan that could increase that count (the developer displayed a build‑out plan rising to 186 batteries and 62 inverters over time). The developers said the site plan uses underground collection lines to tie into the existing substation and intends to use existing turbine access roads for site approaches. NextEra said it has a purchase‑option agreement with the landowner and would only close on the land after completing required surveys and clearances.
Residents raised multiple concerns during the hearing. Questions focused on fire risk and firefighting capacity, chemical contamination and groundwater impacts, audible noise, extreme‑weather resilience, tax distribution and whether the county — and local volunteer fire departments — are prepared for a battery incident. Several speakers mentioned the Long Lake aquifer and asked how runoff or firefighting water might affect groundwater. Josh Adams and other NextEra staff said modern lithium‑ion battery systems are containerized, that historical analyses show combustion byproducts dissipate, and that current recycling technology can recover the majority of metals from retired battery packs. Adams said earlier, older incidents involved building‑scale installations commissioned before NFPA 855 and that modern, containerized designs and new codes have reduced failure rates.
Local residents pressed whether firefighting crews would be expected to enter fenced project areas and whether water‑based suppression would be used; NextEra staff said first responders would primarily monitor incidents from the perimeters and that water can have tradeoffs for cleanup and groundwater — a point company experts said factored into response planning. Multiple speakers asked whether multiple local volunteer fire departments would be trained and whether they have the capacity to respond; NextEra said it plans coordinated training for local first responders and that industry guidance and manufacturers’ procedures would govern on‑site response.
Speakers also asked how the project would be taxed and whether the electricity stored and dispatched would serve Emmons County customers. Sherr said NextEra had been advised by a third‑party firm that the facility would likely be locally assessed but acknowledged uncertainty until state assessment and Public Service Commission processes conclude; he also said the batteries do not “produce” energy but store and dispatch energy that flows through the broader grid, so electrons may move across a regional system rather than being reserved locally.
County commissioners and staff spent substantial time discussing process and fees. Commissioners said the county is in the middle of a multi‑month review of zoning and permitting rules and cited a recently adopted (but still being operationalized) industrial conditional‑use fee structure that some commissioners said would charge a percentage of project valuation rather than the older flat filing fee. Commissioners said the timing of the application — submitted under the county’s existing ordinances and accompanied by a filing check that has not been deposited — put the board in a difficult position: they could accept the application under current rules, deny it, or approve it with conditions while the county finalizes ordinance revisions. Legal counsel for the applicant, attorney Casey Furie, said the application was submitted pursuant to the county’s existing ordinances for electric transmission facilities.
No formal vote on the conditional‑use permit was recorded at the hearing. Commissioners discussed options — approve, deny, or impose conditions — and noted they would weigh public safety and fiscal impacts while the county completes its ordinance and fee‑schedule updates. The record of the hearing remains open for further county action and additional public input.
