The Leander City Council on Sept. 18 unanimously denied a request (Z‑25‑0173) to rezone a 1.1‑acre property in Greatwood from Single‑Family Rural (SFR‑2A) to SFR‑3A. The applicant, property owner Jesse Diaz, said he wanted a larger roof over an outdoor kitchen and related shade structures. Planning staff said several accessory buildings were constructed without permits and the owner faces municipal court enforcement.
Why neighbors opposed it Neighbors told council they moved to Greatwood for the subdivision’s rural character and stated that the requested SFR‑3A zoning would be inconsistent with one‑acre lot standards in that neighborhood. Rolando Ponce, speaking as a nearby resident, said he did not find any neighbors supporting the rezoning and asked council to uphold the existing zoning standard.
Relevant code and enforcement City staff advised council that, under current SFR‑2A rules, the property’s accessory coverage is limited to 1,029 square feet; the applicant proposes 1,213 square feet. Staff told council that two of the owner’s buildings would remain in compliance if the rezoning is denied but at least one structure would need to be removed or reduced to comply. The applicant and staff acknowledged pending municipal court citations; staff said fines for individual code violations range by code section from $0–$500 or $0–$2,000 per citation.
Planning and Zoning and council action The Planning and Zoning Commission previously recommended denial. After public comment and questions about precedent and neighborhood consistency, council voted to deny the rezoning request. No variance or alternative zoning condition was granted.
