Council adopts ordinance removing redundant final site-plan requirement in Eastern Summit County code

The Summit County Council adopted Ordinance No. 995 on Aug. 6 to eliminate a duplicative “final site plan” requirement from the Eastern Summit County Development Code, a change staff said will shorten review timelines and reduce applicant fees.

The county planning attorney and staff told the council the current code required two separate submissions and two separate public hearings for many conditional use permits (CUPs): the CUP review and a separate capitalized, recordable final site plan. Planning staff said the two processes produced largely identical documentation but forced applicants to prepare duplicate materials and attend multiple hearings.

Jennifer (county planning staff, appearing by Zoom) explained the change: removing section 11-4-6 eliminates the second, redundant final site-plan filing and associated signature, recording and public-hearing requirements. She said conditional-use permit site plans and the existing CUP process already capture required information and carry the approval that runs with the land.

Council members asked clarifying questions about whether removing the section would weaken record-keeping or public notice; staff said CUP approvals include the same site-plan details and remain part of the public record. The ordinance also includes minor housekeeping edits and capitalization fixes across the Eastern code.

The ordinance passed after a motion by Councilmember Roger with a second; the motion carried on verbal “Aye” votes recorded in the meeting.

What this means: Applicants for conditional use permits in Eastern Summit County will no longer file a separate “final site plan” under section 11-4-6; instead, the CUP submission and approval will fulfill the record and plan requirements described in county practice. Staff said the change should reduce duplication, costs and time to approval.
