The Polk County Board of Commissioners voted unanimously Aug. 12 to refer an appeal of planning file FD 24-02 to the Polk County hearings officer and to direct staff to schedule required public notices.
Planning manager Sydney Shorter told the board the county had approved the application with eight conditions and that a timely appeal was filed last week. "For the record, I'm Sydney Shorter, planning manager for the community development department," Shorter said. She told commissioners the appeal raised questions about who is the primary farm operator, whether the applicant assists with the farm operation and whether the subject property is leased to other farm operations. Shorter said staff recommended referring the matter to the hearings officer because of the technical nature of the application and because the appeal is not a matter of countywide policy.
During the meeting, one commissioner moved to place the appeal before a hearings officer under Polk County zoning ordinance section 111.28 and to schedule notices as required; another commissioner seconded the motion. There was no further discussion before the board voted "aye" and passed the motion unanimously. The board did not set a hearing date during the meeting.
The action is procedural: it sends the dispute over the planning director's approval and the eight conditions of approval to an administrative hearing rather than resolving the substantive claims on the record.
