The Danvers Conservation Commission on July 24 continued its review of a request for a partial certificate of compliance for 30 Sherwood Avenue, DEP file number 14-1429, to the Aug. 14 meeting.
Staff said the applicant had satisfied most conditions related to the site work but that two conditions in the order of conditions — items 12 and 13 — remained outstanding and were the responsibility of the current homeowners. Emily, the ConCom agent, reported a site visit and recommended issuing a partial certificate of compliance while reserving items 12 and 13.
Why it matters: the Certificate of Compliance (partial or full) documents that work required by an earlier permit has been completed. Items 12 and 13 — described on the record as landscaping and stormwater/planting obligations tied to a performance bond — remain to be completed or secured by the new homeowners.
Public comment and staff view: Pete Clement, introduced as a town-meeting member from Precinct 3, told the commission at the site visit that “everything that you requested has been accomplished” except for a handrail above the water line. Staff and the applicant agreed that because the outstanding items are still in the order of conditions, the commission could release most of the permit but retain conditions 12 and 13.
Action taken: The commission voted to continue consideration of the partial certificate of compliance for 30 Sherwood Avenue, DEP 14-1429, to the Aug. 14 meeting so the applicant or homeowners can appear and the commission can confirm satisfaction of items 12 and 13 or set bond amounts.
Next steps: The applicant (Alex Shuck, North Shore Real Estate Solutions) was directed to appear on Aug. 14 or otherwise provide evidence that the remaining conditions have been satisfied; staff noted the existence of a bond and recommended clarifying its status before final release.
