Council continues public hearing on delinquent water and sewer accounts; staff to schedule special meeting

City utilities staff told the council they had identified 103 delinquent charges eligible for placement that total about $175,000 and that property owners had been notified twice, as required by law. Staff explained the placement is an administrative collection step authorized by the California Health and Safety Code and not a new tax: “This is not a tax that we are implementing. This is services that are already rendered for people who did not pay for the services rendered,” a staff presenter said.
Several council members questioned the fairness of the process. One member argued the action raised constitutional concerns and called it effectively punitive toward people in debt; another member stressed the city’s obligation to collect fees for services rendered so costs do not shift to all ratepayers. Council discussion also noted the city’s practice of offering payment arrangements and staff outreach before sending accounts to the tax roll.
Mayor Hodge called for a roll-call vote to continue the hearing to a special meeting so the full council could consider the matter. The motion passed on a roll-call vote: Council member Arbuckle — yes; Council member Bonamulo — no; Council member Ivey — yes; Mayor Hodge — yes. The meeting record shows the council requested the clerk schedule a special meeting to take the item up again; staff said they will continue to work to remove accounts from the list if they are paid before county submission.
