CHARLTON, Sept. 2 — The Town of Charlton Zoning Board of Appeals voted Tuesday to grant a 5-foot side-yard setback variance for a retaining wall at 78 Jennings Road.
Applicant Rick LeBlanc told the board the retaining wall sits on the property line and that the neighbor had indicated no objection. The board discussed that the retaining wall was installed by a subcontractor without final authorization from the owner and that the installed solution was the only workable option given site conditions. A board member described photographs showing a significant grade difference that required the wall.
After an unnamed member moved to grant the variance for a 5-foot setback on the northern side and another seconded, the motion passed. The board noted the standard 20-day appeal period; any occupancy decisions remain under the authority of the building commissioner and are not automatic upon the variance grant.
The board did not record additional conditions beyond the expected administrative steps. The applicant was told to coordinate with the town clerk and the building commissioner about subsequent permitting and inspection as needed.
