Orderville approves conditional-use permit and business license for Wild Turkey Way vacation rental

A neighbor in the planning-and-zoning meeting, identified in the record as Jenkins (Eric Jenkins), opposed the permit because access to the property uses a route that crosses Jenkins’s land. Board members discussed whether an unrecorded prescriptive easement might exist, but the town attorney’s guidance—cited by board members—was that easement disputes are a civil matter between property owners and not grounds for denying a conditional-use permit if the zoning application meets municipal criteria. “You deal with the permitting. You deal with the request. Do not litigate the easement,” a board member said, summarizing prior attorney advice.
The board noted planning and zoning recommended approval with conditions that include prohibiting “big events” (weddings, large parties) that would change the use profile. The conditional-use permit motion passed 3-1. Later the board moved and seconded approval of the business license for Wild Turkey Way LLC; that motion carried 4-0.
Board minutes and meeting discussion show the town will not determine the legal status of any easement and that any property-access disputes will remain a civil issue for the landowners to resolve. The board’s approvals allow the owner to operate the dwelling as a vacation rental subject to the standard conditional-use conditions adopted by planning and zoning.
