On Aug. 11, 2025, the Kenai Peninsula Borough Plat Committee granted preliminary approval to the Kynitzy Acres subdivision (KPB file 2025-0100) and voted to allow two exceptions to the borough subdivision code, following a staff recommendation and brief public comment.
The Kynitzy Acres preliminary plat proposes dedicating multiple utility easements and two cul-de-sacs on the north side of Redoubt Avenue. In his staff report, Vincent (staff member) described proposed easements including a 30-foot-by-487-foot utility easement, a 30-foot-by-180-foot utility easement, and the dedication of two cul-de-sacs connected to Redoubt Avenue; the plat proposes exceptions to KPB subdivision provisions governing proposed street layout, block length, and cul-de-sacs. Staff recommended granting the exceptions and placing notes on the final plat indicating any exceptions and the meeting date.
During public testimony, resident Elizabeth Cooper said she had not been aware of drainage exceptions or the proposed cul-de-sac behind her property and urged the committee to reconsider drainage impacts and neighborhood safety. "I did not know there would be drainage exceptions," Cooper said, adding concerns about recent beaver-trapping and drainage work by the city of Kenai near her property.
Robert Ruffner, the planning director, clarified for the record that a page was missing from one resident's mailed packet and confirmed the committee was not voting on any drainage-easement exception that would change the borough's code compliance review. "There was one page missing from the packet that the testifier had," Ruffner said; he explained staff believed the mailed materials otherwise went out correctly and that the cul-de-sac exception under consideration concerned future roadway configuration rather than immediate removal of drainage protections.
The committee made three separate votes: it approved the preliminary plat; it granted Exception A (relief from KPB 20.30.030 proposed street layout and KPB 20.30.170 block length, citing the staff findings tied to the code standards); and it granted Exception B (relief from KPB 20.30.100 cul-de-sac requirements, citing the staff findings). Roll-call votes on the exceptions and the main motion were recorded as: Commissioner England — Yes; Commissioner Morgan — Yes; Commissioner Whitney — Yes; Commissioner Venuti — Yes; Commissioner Gillum — Yes. All motions passed.
Staff will place notes on the final plat documenting any exceptions granted and the meeting date, and the preliminary approval is subject to final compliance with KPB code and the staff report.
The committee's action preserves the option for future roadway extensions and records the exceptions on the official plat, while staff and the planning director noted that drainage-related concerns raised by the resident do not change the exception vote taken at this meeting.
