Staff proposes one-year waiting period for applicants denied at City Council to reapply for conditional use permits

Planning staff told the commission they will initiate a zoning text amendment to require applicants denied by City Council to wait one year before reapplying for a conditional use permit (CUP). The change would mirror an existing requirement for rezonings.

"Right now if you apply for rezoning, you go all the way to council, you get denied, you have to wait a year before you reapply unless what you're proposing is substantially different," a staff member said. "For some reason, we didn't have that in there about conditional use permits. So we're just initiating that."

Staff said the text language will be provided to the commission for review and that the amendment will be available for consideration at the commission’s November meeting. No formal vote was taken at the meeting; staff characterized the item as an initiation of the amendment and said more detailed language will be drafted for the commission and the public.

Commissioners briefly discussed timing and the administrative steps needed to publish the change and noted that including CUPs in the same one-year restriction as rezonings responds to concerns about repeated, successive applications following a Council denial.

If the amendment proceeds, applicants who have been denied a CUP by City Council would be barred from filing a new, substantively similar application for one year unless the new proposal is substantially different, staff said. Staff will provide the draft text and a timeline for public notice and review in the coming weeks.
