APC approves Lang Manor subdivision and sidewalk waiver; water main extension and dye test required before recording

The Area Plan Commission on April 3 approved the Lang Manor primary plat (MAJ-2025-001) dividing a parcel on Denzer Road into a 1.7-acre Lot 1 with the remaining acreage to be designated as a parcelization remainder. The commission also approved a requested partial sidewalk waiver.
Staff explained the subdivision had become a major plat because the Evansville Water & Sewer Utility required a public water main extension to remedy an illegal tap and serve Lot 1. The county health department also required a dye test on the existing home because a converted barn was being used as a dwelling without prior permits.
Staff recommended approval with conditions, and the commission approved the plat on an 8-0 roll call vote. Conditions listed in the staff report that the commission adopted require: (1) construction and acceptance of the water main extension by Evansville Water & Sewer Utility prior to secondary approval and recording of the plat; (2) completion and approval of a dye test on the existing home as required by the Vanderburgh County Health Department; (3) recording the ingress/egress easement and referencing it on the plat; and (4) completion of the sidewalk waiver statement or, if a waiver is denied, installation of sidewalks before certificate of occupancy.
Staff noted neither the county engineer nor the Evansville MPO objected to the sidewalk waiver; both supported the waiver in the staff report. On roll call the APC approved the subdivision plat and the sidewalk waiver, 8-0.
