A nuisance-property matter at 522 South Fifth Street is now in the hands of the city’s attorneys, and the city has rejected a request for a special accommodation from Oxford House’s legal representative, city officials said March 27.
Resident Aaron Dustin asked the council for an update on the property. A city official told the meeting that a citation had been issued (the transcript records a citation and two closely related dates discussed by staff) and that the file now sits with the city attorney.
Officials said they had received a multi-page letter from an attorney in Washington, D.C., representing Oxford House nationwide that requested an accommodation for the property’s occupants. The city responded by stating it would not provide a special accommodation and that local occupancy limits—council representatives referenced a limit of no more than three unrelated people—would be enforced. The city cited U.S. Supreme Court cases in its written response, according to the official account given at the meeting.
Staff told the council the next enforcement step would be to issue an occupancy violation; if occupants do not comply, the city’s planned course is to pursue court action. No further procedural details or timing were provided at the meeting.
