The Elbert County Planning Commission continued the WF Real Estate rezone (RZ-2024-0023) to the commission’s April 15 meeting after commissioners and public commenters raised questions about water adequacy, road access and packet completeness.
Planner Kelsey Lanham presented the application for a 40.035-acre parcel southeast of Sun Country (Parcel 64251-00-023). Applicant John Wilson attended and confirmed the requested rezoning from Agriculture to Residential Agriculture. Lanham told the commission the packet included a physical copy of the sign-posting affidavit and noted the applicant requested the affidavit to be notarized after the 14-consecutive-day posting window; staff said the sign had been posted March 12 and affidavit notarized after March 26.
Public comment included a question from Bill Henry asking whether proposed roads would meet secondary-egress and emergency standards and whether winners circle/Winners Circle Road would become a county-maintained road. Commissioners asked Public Works and the county engineer to confirm whether internal road construction would become a county maintenance responsibility or remain a private burden and to provide written confirmation in the packet.
Commissioners also examined water-related referrals. Kelsey Lanham said the Division of Water Resources (CDWR) had issued earlier letters that raised water adequacy questions for similar parcels; commissioners requested any updated CDWR correspondence or evidence of water-right ownership and pump tests when applicable. The applicant said he had provided documentation and that the property had existing acreage water rights appropriate to the zoning being sought, but commissioners asked staff to include any DWR follow-up letters in the packet for April 15.
After discussion the commission voted to continue the WF Real Estate rezone to April 15, 2025, to allow staff and the applicant to supply outstanding referral letters, a clearer record of sign-posting affidavits and confirmations from Public Works about road standards and maintenance expectations. The commission noted the rezone will not be effective until the BOCC acts and any conditions of approval are satisfied.
